Terms of use
This translation is for information only. The Spanish text is the binding one: if the versions differ, the Spanish version prevails. Read the Spanish version
These terms govern the use of the menumentos app for iOS and Android and of the website menumentos.com (together, «menumentos»), provided by CLAUDIA TECH, S.L. (trade name ClaudIA Tech), tax ID B93811149, with its registered office at Calle Gumersindo Azcárate, 8, 45200 Illescas (Toledo), Spain («we»). You can contact us at info@menumentos.com.
By using menumentos you accept these terms; if you create an account, you also accept them expressly when you sign up. If you contribute content, the community terms also apply. How we process your data is explained in the privacy policy.
1. What menumentos is
menumentos is an audio guide for walking around Spanish towns and cities: guided routes and free walks with alerts when you pass near a point with a story. It is free and is funded by advertising, by optional paid passes and routes, and by sponsorships.
- Offline: with a city’s pack downloaded, the app guides you offline. The map, ads, purchases, contributions and «ask the guide» need a connection.
- Content and artificial intelligence: the stories are researched, written, checked and translated by artificial intelligence agents, and a person from our team always reviews and approves them before publication and is responsible for them. The voices of the stories are synthetic voices, generated by computer.
- «Ask the guide» is an artificial intelligence assistant: you are talking to a machine, not a person. It answers only with the point’s verified content, but it can make mistakes.
- Website: it shows excerpts, maps and community stories; the full stories and the audio are in the app.
We may add, change or remove cities, routes, points and features. If we remove something you have bought, section 5 applies.
2. Who can use it
Anyone can use the app and the website without signing up. To create an account you must be 14 or older, and you declare so when you sign up. To contribute content to the community you must also be 14 or older.
If you are a minor, use menumentos with the knowledge of your parents or guardians, especially to make purchases.
3. Your account
- You can sign up with Apple, with Google, with a link sent to your email or with email and password. The same account works in the app and on the website.
- When you sign up, what you did without an account on that phone (purchases, progress) moves to your account.
- Protect access to your email, your password and your Apple or Google account: whoever gets into them can get into your menumentos account.
- You can delete your account whenever you like from the app or from menumentos.com/en/account. Deleting it deletes the passes and routes linked to it; purchases made on the App Store or Google Play can be recovered with «Restore purchases» using the same store account. What happens to your contributions is explained in the community terms.
4. Proper use
When using menumentos you agree not to:
- use the app in a way that endangers your safety or that of others (section 7);
- try to access other users’ data, non-public parts of the service or our systems;
- extract the content (texts, audio, packs) in bulk or reuse it outside menumentos without permission, except where the law allows it;
- try redemption codes by brute force, or tamper with purchases or rewarded videos;
- send false or bad-faith reports;
- use menumentos for illegal purposes.
If you breach these terms we may warn you, suspend or close your account, proportionately and with reasons, and you may appeal (see the community terms, section 8).
5. Passes, routes and purchases
| Product | What it gives |
|---|---|
| 24-hour pass | No ads, premium routes and unlimited «ask the guide» for 24 hours from purchase |
| 7-day pass | The same for 7 days from purchase |
| Premium route | Access to a specific premium route for as long as menumentos provides the service |
| Code | A route or pass sold by third parties (agencies, hotels, promotions), redeemed in the app |
| Rewarded video | Watching an ad unlocks a premium route for 24 hours |
| Community reward | A free pass when a contribution of yours is published |
- Price: the one shown by the store before you buy, taxes included.
- Who sells: in-app purchases are sold and charged by Apple (App Store) or Google (Google Play), under their payment and refund terms. We never see your card details. Passes do not renew automatically.
- Restore purchases: from the app settings, with the same store account.
- Duration: passes run from purchase or redemption, even if you do not use the app.
- Right of withdrawal: passes and routes are digital content delivered immediately. When you confirm the purchase you expressly ask for it to start at that moment and accept that, as a result, you lose the 14-day right of withdrawal (Article 103.m of the Spanish consolidated General Law for the Protection of Consumers and Users). This does not affect Apple’s and Google’s refund policies.
- If something does not work: you have the legal guarantees for digital content (Articles 114 et seq. of that law). Write to info@menumentos.com and we will fix it or, if we cannot, help you get a refund.
- If we remove a premium route you bought, we will give you at least 30 days’ notice and offer you, as you prefer, another premium route in the same city or a refund of what you paid.
- If we shut down the service, we will give you at least 60 days’ notice. Passes remain valid until they expire and we will refund what you paid for premium routes bought in the 12 months before the notice.
- Codes: they are valid for what the code says and until it expires, and cannot be exchanged for money. If you bought the code from a third party, that sale is governed by the third party.
- Community rewards and rewards in general: they are free, personal and non-transferable, and cannot be exchanged for money.
6. menumentos content
- The texts, audio, voices, routes, our own maps, the «menumentos» brand, the logo and the design belong to us or our licensors. We allow you to use them for your personal, non-commercial use within menumentos.
- Some map data comes from OpenStreetMap (© OpenStreetMap contributors, ODbL licence) and the website’s map tiles from OpenFreeMap. The app’s map is Google Maps, with its own terms.
- Accuracy: we check the content against sources and a person reviews it, but history is a field with different versions and errors. If you find one, let us know from the app: if we fix it, you get points.
- Community content: stories marked «from the community» are proposed by a user and edited and approved by our team before publication. You can hide what a person publishes and report any content.
- Advertising and offers: ads, sponsored stops (marked «Sponsored») and third-party ticket offers (marked «Affiliate link») belong to their advertisers or providers. If you buy something from a third party, the contract is with them. Nothing interrupts a story: ads never play in the middle of one.
7. Walk with care
menumentos is designed to be listened to while you walk. For your safety:
- Watch where you are going. Follow traffic rules and signals and do not look at the screen when crossing. Use a volume that lets you hear what is going on around you.
- Routes are on foot and we draw them with open data (OpenStreetMap). They may have roadworks, closures, stairs or slopes we do not know about. Accessibility information is a guide only.
- Do not enter private places or places closed to the public to follow a story or an alert. Respect the opening hours, the rules of each monument, church or natural area, and local residents.
- Natural sites: some community places are outside towns. Check the state of the path and the weather beforehand, carry water and suitable footwear, and do not take risks. The safety notes we include do not replace your own caution.
- Battery: the app uses location in the background during a walk; make sure you have enough battery.
You decide where you walk. We are not liable for damage you suffer from not following these recommendations or from the condition of the roads, places or spaces you visit, which do not depend on us. This does not limit our liability for damage caused by our wilful misconduct or fault, for damage to life, health or physical integrity, or in any other case where the law does not allow it to be limited.
8. Availability and liability
- We do what is reasonable for menumentos to work well, but there may be interruptions due to maintenance, provider failures or causes beyond our control. Offline, the app keeps guiding you with the downloaded pack.
- We are not liable for third-party content we link to (ticketing websites, advertisers), or for indirect damage or loss of profit, to the extent permitted by law.
- Nothing in these terms limits the rights that consumer law gives you.
9. Changes to these terms
We may change these terms due to changes in the service or in the law. If the change is important, we will let you know in the app or by email at least 15 days in advance. If you do not agree, you can stop using menumentos and delete your account; what you have already bought keeps the conditions under which you bought it.
10. Languages
These terms are published in Spanish, English, French, German and Simplified Chinese. The translations are for information: if the versions differ, the Spanish version prevails.
11. Governing law and complaints
- These terms are governed by Spanish law.
- If you are a consumer, you can bring a claim before the courts of your place of residence. If you are not, before the courts of Illescas (Toledo).
- Before that, if you wish, write to info@menumentos.com: we will reply within one month at most. You can also use the official complaint forms and the consumer services of your Spanish region.
- We are not members of the Spanish Consumer Arbitration System or of any other alternative dispute resolution entity. If we do not resolve your complaint, we will tell you in writing whether we agree to go to an accredited entity.
