Community terms
This translation is for information only. The Spanish text is the binding one: if the versions differ, the Spanish version prevails. Read the Spanish version
These terms apply when you contribute a place, an anecdote, a route or photos to menumentos, provided by CLAUDIA TECH, S.L. (trade name ClaudIA Tech), tax ID B93811149, with its registered office at Calle Gumersindo Azcárate, 8, 45200 Illescas (Toledo), Spain («menumentos» or «we»). They complement the terms of use and the privacy policy.
In short: tell us what you know about your town or city; our team reviews it, rewrites it in the house style, gives it a voice and publishes it with your name. You remain the author of what you wrote and give us permission to use it; the version we publish is prepared by us from your text.
1. Who can contribute
- People with a registered account on menumentos (an anonymous session is not enough).
- Aged 14 or older. You declare so when you contribute. If you are under 14, you cannot contribute (Article 7 LOPDGDD).
- If you are between 14 and 17, your mother, father or guardian must know and accept these terms, including the licence in section 4; when you contribute you declare that this is the case.
- With a public name of your choice, which can be a pseudonym, and which does not impersonate another person or a brand and is not offensive.
- Who have accepted these terms in their current version.
- Who are not under a suspension or ban (section 8).
2. What you can contribute
From any town, city or natural site in Spain, not just from the cities with official routes:
| Type | What you write |
|---|---|
| Place or natural site | Its name, its location on the map, the story in your own words, what to see, safety notes and up to 3 of your own photos |
| Anecdote | What you know about a point already on menumentos and how you know it |
| Route | From 3 to 15 stops, with a note for each one |
You choose the location of a place on the map; we never use your phone’s location.
We do not accept:
- content that is illegal, incites hatred, violence or discrimination, or is offensive or insulting;
- personal data of other people (names, addresses, private stories) that is not historical or related to the place;
- photos showing recognisable people, or legible number plates;
- text or photos copied from others (books, websites, guides, Wikipedia) or to which you do not hold the rights;
- private places or places closed to the public, dangerous places, or directions that invite people to take risks (entering ruins, climbing fences, approaching cliffs);
- advertising, promotional links or spam;
- invented facts presented as true;
- places outside Spain.
You can send at most 3 contributions a day; we may change this limit to prevent abuse.
3. How it is reviewed and published
- You send your contribution from the app or from menumentos.com/en/contribute.
- It is screened by a person from the team or by an automated artificial intelligence system, which only leaves notes for the team (for example: possibly copied text, third-party data, nearby duplicate). The automated system never decides.
- A person from the team decides: accepts it, asks you for changes with a message, or rejects it with a reason.
- If accepted, we prepare the text for listening with our style guide, without adding facts, and remove personal data that is not historical or related to the place. We may do so with the help of an artificial intelligence system, but a person from the team always approves the final text, comparing it with what you wrote.
- We translate it into the city’s languages and give it a voice with the city’s synthetic voice.
- We publish it: it appears on the website and in the app with a connection immediately, and in the downloadable packs that night.
We are under no obligation to publish any contribution, or to do so within a set time. We let you know about every change of status in the app and in your account.
4. Your rights over what you contribute and the licence to menumentos
4.1. You remain the author. What you write and the photos you take are yours. You can keep using them however you like, including publishing them elsewhere.
4.2. Licence to menumentos. By sending a contribution you grant us, over its text, its photos and the route information, a non-exclusive, free licence, worldwide and for the full term of the intellectual property rights, with the right to sublicense its use to our providers and partners to the extent needed to provide the service, to:
- reproduce and store them in our systems, in the downloadable packs and in backups, on any digital medium;
- transform them: edit, summarise, adapt them to the house style, combine them with other content and translate them into any language;
- voice them, with synthetic or human voices, and create audio from them;
- distribute and communicate them to the public, including making them available online, in the app, the website, the packs, the app store listings, social media and the promotion of menumentos, also in paid formats (premium routes, passes) and with advertising.
The licence continues even if you delete your account, for what was already published (section 7), except for photos, which are deleted.
4.3. The published version. The text we publish is not yours as it stands: it is a derivative work we prepare from your contribution, in the house style, which we translate and voice. The rights over what we contribute (the final wording, the translations and the audio) belong to menumentos, and the licence in section 4.2 allows us to use that version. Your rights over your original text do not change. We keep your original text exactly as you sent it, as a record of what you contributed.
4.4. Your moral rights. An author’s moral rights cannot be waived, and we respect them. By contributing you consent to the adaptations needed to publish your contribution on menumentos (style, length, translation, voicing and removal of personal data), which we will make without distorting what you told us or harming your reputation.
4.5. Credit. We publish your contribution with your public name on screen («told by…»), which can be a pseudonym. The credit does not appear in the audio. If you delete your account, or ask us to remove your name, the contribution stays published anonymously.
4.6. No payment. We do not pay for contributions. What you receive are points, badges and free passes (section 9).
5. What you guarantee
By contributing you guarantee that:
- the text is yours or you can use it freely, and you have not copied it;
- you took the photos yourself, they do not show recognisable people and they do not infringe anyone’s rights;
- what you tell us is true to the best of your knowledge and you tell us how you know it;
- you do not include third-party personal data unless it is historical or related to the place;
- you do not break the law or infringe third-party rights (intellectual property, honour, privacy, image rights).
If a third party makes a claim against us over something you contributed in breach of these guarantees, we will remove the affected content and may apply the measures in section 8. You are liable for the damage you cause through that breach as provided by law.
6. Personal data
- About you we process your public name, your handle, your email, what you contribute and the history of your contribution, as explained in the privacy policy.
- If screening or editing is done with artificial intelligence, your text is processed by a provider (Anthropic) only for that purpose. Photos are kept in private storage until published, without their metadata.
- Third-party data: do not include it. If any slips in, the team removes it when editing the text. If someone appears in a published story and wants us to remove them, they can write to info@menumentos.com or report the content.
7. If you delete your account or want to withdraw something
- What was not published (drafts, under review, rejected or withdrawn) is deleted with the account.
- What was published (places, anecdotes and routes) stays published without your name: the credit disappears from the website immediately and from the packs that night. Your original text is kept without an author.
- All your photos are deleted, including published ones: those in our private storage immediately and their public copies at the next publication of the packs.
- Your points, level and badges are deleted with the account.
As long as it is not published, you can withdraw your contribution yourself from the app or from your account. If you want us to withdraw something already published without deleting your account, write to info@menumentos.com: we remove your name whenever you ask, and we withdraw the contribution when there is a justified reason (for example, it affects your privacy or someone else’s, contains an error or infringes third-party rights). In other cases we consider it and give you a reasoned reply within one month at most.
8. Moderation, reports and appeals
8.1. Reasons why we may reject or remove a contribution, always decided by a person:
| Reason | What it means |
|---|---|
| Spam or advertising | Promotion, commercial links or content unrelated to the place |
| Offensive content | Insults, hatred, violence or discrimination |
| Personal data | Third-party data that is not historical or related to the place, or photos with recognisable people |
| Copied content | Text or photos by others, or without rights |
| Dangerous or private site | Private or closed places, or places that invite people to take risks |
| Outside Spain | The place is not in Spain |
| Duplicate | It already exists on menumentos |
| Too short | Not enough for a story |
| Other reason | Explained in the message |
8.2. Reporting content. Anyone, with or without an account, can report community content from the app or the website, giving the reason (illegal content, offensive, personal data, copyright, dangerous site, false information or other) and an explanation. If you report from the website without an account, we ask for an email address so we can reply. Copyright holders can use the «copyright» reason or write to info@menumentos.com identifying the work and the content. We confirm that we have received the report, handle it diligently and let you know what we decide.
8.3. Measures. If you breach these terms we may, proportionately: remove the content, warn you, suspend your account from contributing for a period, or ban you. If we remove a contribution for breaching these terms, we may cancel the points it gave you and the reward pass if you have not used it yet. A person from the team always decides. Each user can hide what another publishes, and nobody can see whom another person has hidden.
8.4. We explain the reason. Every rejection, removal, suspension or ban reaches you with its reason, the facts it is based on, whether automated means were used (screening only flags; a person decides) and how to appeal.
8.5. Appeals. You can appeal against any of those decisions, and whoever made a report can appeal against our decision, for 6 months from when you learn of it, by writing to info@menumentos.com. It is reviewed by a person from the team other than the one who decided, and we give you a reasoned reply. You can also go to an out-of-court dispute settlement body certified under Article 21 of the Digital Services Act, or to the courts.
8.6. Point of contact. For authorities and users: info@menumentos.com, in Spanish or English.
9. Points, levels, badges and rewards
As of the date of these terms, the points and rewards are as follows; the current values are always on the community page:
| What happens | Points | Reward |
|---|---|---|
| A place or natural site is published | 50 | 24-hour pass |
| An anecdote is published | 30 | 24-hour pass |
| A route is published | 80 | 7-day pass |
| An error you reported is fixed | 10 | «Sharp ear» badge |
| A photo from your contribution is published | 10 | — |
- Points are given only once per contribution published or per error fixed. The levels are: neighbour, chronicler, senior chronicler and guardian.
- Points, levels and badges have no monetary value and cannot be sold, transferred or exchanged for money. There are no prize draws or cash prizes.
- Reward passes are governed by the terms of use and expire like any pass.
- We may change the points and rewards table for the future; what has already been earned is kept, except as provided in section 8.3.
- If you turn on your public profile, your name, level, badges and published contributions appear on your profile page on menumentos.com and in the community leaderboard.
10. Changes to these terms
Each version has its identifier and date. If we change them, we ask you to accept the new version before your next submission. Contributions you have already sent are governed by the version you accepted when you sent them, unless the new one is more favourable to you or is required by law.
11. Languages and governing law
These terms are published in Spanish, English, French, German and Simplified Chinese; if the versions differ, the Spanish version prevails. They are governed by Spanish law, with the courts set out in the terms of use.
